Job Description: Experience in the GCC region * A verifiable record of 12+ years experience in contract administration, with at least 3 years at a senior level in contract administration/ quantity surveying in an engineering/construction/project management environment. * Strong report-writing skills in the English language. Arabic is an added asset. * Experience with large scale construction projects (valued over US$ 50 million). Our Client is a contracting company established in 1973 and operating from offices located in Abu Dhabi and Dubai, UAE. The company has successfully executed several multi-disciplinary projects in a wide variety of fields. They are among the market leaders in building pipelines and pumping stations. Its current workforce is around 2000 laborers and 1000 technical, administration and engineering staff. The company's annual billings are currently valued over AED 800 million. Our Client has become specialized in the engineering and construction/contracting sector that covers municipal mechanical & electrical engineering works as well as the civil construction work associated with these installations and other similar industrial projects. It offers services on a turnkey basis, namely engineering procurement, construction and commissioning. Our Client is seeking a high caliber professional to fill the role of Commercial Manager. The mission of the role is to lead the contract administration function from the project-tendering phase all the way through to post-construction. The Commercial Manager will be involved in assessing financial and commercial risks associated with contractual agreements while providing counsel to manage and minimize risk exposure. The position is based in Abu Dhabi, UAE. and reports to the Managing Director. Position Objectives & Key Responsibilities: 1. Review all existing contract administration function processes and systems and recommend modifications to streamline procedures, build-up resources and upgrade efficiency to ensure compliance with best practices and enhance the quality and reliability of its input to decision-making. 2. Review and develop processes, systems and procedures in order to provide continuous contractual and commercial support to projects from inception phase to completion as follows: a. Pre-Contract Phase: Contractual review, qualification and risk analysis of tender documents. Analysis of commercial aspects of project tenders: quantity surveying and management of tender bonds. Participation in the preparation, review and negotiation of Pre-bid Agreements and liaising with legal advisors regarding Memoranda of Understanding, Joint Venture and/or Consortium Agreements. b. Contract Award Phase: Review and acknowledgement of Letters of Award and Contracts, and compilation of the Contract Documents. Management of Bonds (guarantees) and Insurances. Review of sub-contracts and purchase order terms. c. Contract Performance & Construction Work in progress: Ensure proper management and control of all contract-related documentation including correspondence, meeting minutes, action items, requests for information, contract change notices and authorization. Ensure that progress, quantity surveying and monitoring takes place and is recorded as per the contract document requirement. Monitor the planning and scheduling of shop-drawing submittals and material-approval transmittals. Prepare valuation for interim and final payments, pricing variations notices, etc. to ensure compliance with terms of contract and timely progress of the works. Review periodic site progress, cost reports, forecast total value of contracts and advise on potential claims as well as cost-control implications. Provide commercial support to project teams for efficient management of the procurement needs during contract executions. d. Post-Construction: Prepare and administer final valuations and settlement of final accounts. Lead claims preparation and defense. Advise on dispute settlement resolution. When required, liaise with legal advisor/counsel and provide support in arbitration, mediation or courts. 3. Support the goals and performance objectives of the Company and its contracted projects through: providing advice and commercial support to Group Management, managing projects, and actively participating in project progress meetings as well as periodic management meetings. 4. Contribute to fostering good relationships with existing clients and clients' representatives to support business development efforts.
