My construction employer is going through layoffs. What can be negotiated in regards to severance? How?
Many construction employers offer a standard severance package that may include several weeks of pay and benefits. How much is up to the ex-employer as this isn't regulated. If your contract has an 'at will' clause, the ex-employer can leave you with very little. You can negotiate your package, but don't be too pushy about it or you may end up with less than a standard package.
A few things you should remember when negotiating:
1. Remember your position and why you're being laid off. If it's because of anything negative, then your bargaining power is limited;
2. Always negotiate with a decision-maker;
3. Don't be bullied into a quick decision or a deadline as it can be extended;
4. Set a realistic goal;
5. Be persistent and stress the fairness of the situation;
6. Don't be embarrassed by explaining hardships you'll face; and,
7. Remind your construction employer of the faithful service you've given and prepare a list of accomplishments. |
